
TRANSFER PURSUANT TO COURT ORDERS
This category of transfer occurs following a directive of a court, often following a separation or divorce. Typically, property is transferred from multiple parties to one party, in accordance with court orders. In effect, this involves both a sale and purchase component along with a "paper" or "in person" settlement.

Our fixed fee includes:

Reviewing orders of the court

Undertaking a Verification of Identity (remote)

Drafting a Verification of Identity letters

Assisting you obtain a Foreign Transfer Duty Declaration Form

Lodging the Transfer of Land, together with court orders, for duty assessment

Applying for duty to be assessed at a nominal rate (if applicable)

Assisting you obtain a Foreign Resident Capital Gains Clearance Certificate

Drafting the Transfer of Land (paper)

If required, undertaking and providing you with all statutory searches

If required, drafting the Financial Settlement Statement

Liaising with all banks and parties to arrange settlement

Attending settlement (in person)
Fees exclude disbursement such as statutory searches, Landgate and PEXA fees and Transfer Duty.
