
MORTGAGEE'S CAVEAT
A mortgagee's caveat is lodged by a lender (mortgagee) who has taken a mortgage over property, but the mortgage has not yet been registered. This often happens where there is a delay in processing documents or where the lender has a non-registrable mortgage, such as an equitable mortgage created by agreement. Even though the mortgage is not on the title, the lender still has an enforceable interest in equity.

By lodging a mortgagee's caveat, the lender ensures that no other interests can be registered without first being notified, preserving their priority as a secured creditor.
