
CHARGEE'S CAVEAT
A chargee is a person or entity that holds a charge - typically a form of security - over property. This often arises in commercial lending or contractual relationships where one party agrees to provide security over property to ensure the performance of an obligation.
For example, a supplier might extend credit to a business in return for a charge over the director's personal property. If the charge is not registered as a mortgage, the supplier can lodge a chargee’s caveat to protect that interest.
This type of caveat acts as a notice that the property is subject to the charge and prevents the landowner from disposing of or encumbering the property without first resolving the chargee's interest.
